Regulations of the bangbag online service

These regulations define the rules of sale between the feelgood limited liability company with the registered office in Krakow, ul. Turystyczna 2, 31-213 Kraków, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court for Kraków-Śródmieście in Kraków, XI Commercial Division of the National Court Register under KRS number 0000507733, NIP 9452179077, REGON 123104804, hereinafter referred to as the “Seller”, and the entrepreneur placing the order, hereinafter referred to as the “Ordering Party”. Placing an order through the website, as well as outside it, means that the Ordering Party accepts these Terms and Conditions of the Website.

Placing orders

Orders are accepted only in writing. The order must contain the name of the Buyer and information necessary to issue a VAT invoice – NIP (tax number), REGON (the National Official Register of National Economy Units), registered office, address, full name of the company. In addition, please provide the name and surname of the person authorized to place orders and contact phone number and e-mail. Placing an order in an online warehouse is tantamount to authorizing the Seller to issue a VAT invoice in an electronic version, without the Buyer’s signature, unless the Buyer explicitly states otherwise.

Orders are placed on the order form provided by the Seller, posted on the website www.bangbag.pl. The information contained in the form should be true, complete and current. The Seller reserves the right to refuse to execute the order, if the details of the Buyer given in the form are untrue, out-of-date or inaccurate, in such a way that they make it impossible to perform the order, and in particular delivery of the goods. In the event that it will be possible to contact the Buyer, the Seller will contact the Buyer before the refusal to execute the order to complete the data to the extent enabling the order to be processed.

The seller undertakes to update product data and specifications, including information on the number of available products and the availability of colors in given quantities, within 48 hours of the change. If it is not possible to fill the gaps in the available quantity of products, the Seller reserves the right to cancel the order and immediately inform the Buyer.

After placing the order, the Buyer receives automatically generated confirmation of placing the order. It is a confirmation of the correctness of the entered data regarding the order, data of the Buyer and data for the VAT invoice.

After placing an order electronically, a confirmation of placing an order is generated, which serves as the basis for making the payment.

Order fulfillment

After placing the order by the Ordering Party, the Seller shall immediately proceed with the order. The Seller confirms to the Ordering Party the fact of accepting the order and joining it to the address provided by the Ordering Party in the order.

Orders of products without printing are carried out within 7 business days from the date of order and sent by courier to the address of the Ordering Party, unless the Parties have agreed otherwise. Orders of products with imprint or otherwise personalized are carried out within 14 business days from the date of order.

The Seller reserves the right to delay the performance of the order in the event of unforeseen circumstances, independent of the Seller, and which may affect the Seller or subcontractors.

The goods are sent to the Ordering Party on the basis of the payment booked on the Seller’s bank account (not applicable to ordering parties who have entered into an overflow agreement with the Seller).

Until the payment is completely settled by the Ordering Party, the goods remain the property of the Seller.

The Ordering Party may make changes to the order for products without imprint or non-personalized or withdraw the order until the order has not yet been given to the Ordering Party. In the case of products with imprint or otherwise personalized, making changes to the order is possible only until the production process begins. Subsequent notification of changes will be treated as late and is not subject to complaint.

The seller informs in an unambiguous manner about the features of the presented products. The technical data of the products are consistent with the data provided by the manufacturer and the manufacturer is responsible for the non-compliance of the product with the description.

The seller is not responsible for photos and descriptions placed on individual products. The pictures of products placed on the website are examples and are used to present the goods.

Terms of payment

Payment is made according to the choice of the Buyer, or by a traditional bank transfer to the account indicated by the Seller, and placed on the website www.bangbag.pl. The Seller reserves the right to choose the payment method, which should be made by the Buyer, due to the special order size, non-standard shipping region or other substantive criteria, about which the Buyer will be immediately informed after the order is accepted by the Seller.

Payment for the order referred to in point 1 should be made within 7 days from the date of placing the order to the Seller. In the absence of receipt of the payment made by the Buyer on the eighth day from the date of order, the order will be automatically canceled without further notification.

Exceeding the deferred date of payment agreed by the parties, other than the one specified in point 2 of this paragraph, constitutes the basis for charging by the Seller interest for delay in payment of the sum of money due in the maximum amount, in accordance with the applicable provisions, and the debtor’s charge costs of reminders.

If the Buyer makes a payment before receiving the confirmation of availability by the warehouse administrator and as a result, an overpayment will occur – the Seller will refund the overpayment within 30 days.

Delivery terms

Deliveries are carried out only by a courier company chosen by the Seller.

The ordering party covers the costs of transporting the goods in full, in particular when delivering the order in several lots. The Seller issues a VAT invoice to the  Ordering Party each time for shipping costs.

In the case of damage to cardboard boxes or other visible damage, the Purchaser is obliged to annotate the damage on the consignment note in the presence of a courier and recalculation of the goods in the presence of the courier. The signature of the Ordering Party or the person authorized to act on its waybill on his waybill means that the parcel is in conformity with the order. In the event of objections regarding the condition of the shipment – the courier is obliged to draw up a “Damage Report” in two copies, one for each party. In the described case, the Ordering Party has the right to refuse to accept the parcel. Acceptance by the Purchaser of the shipment without reservations shall result in the expiration of claims for loss or damage.

As a standard, garments with print and embroidery are packed in cardboard boxes. Any other packaging method involves additional fees. The amount of these fees is determined individually with the Ordering Party.

In case when the Ordering Party sends the goods intended for printing, the moment of commencement of the order execution is understood as the moment of accepting the whole item for storage and receiving confirmation of the bank transfer – agreed by the parties.

Principles of cooperation with the printing house

Before placing an order, the Buyer may commission a test decoration. The purpose of the test is to eliminate any errors or uncertainties that could arise in the production process.

The Buyer is obliged to pay a fee covering the total costs of the test. The Buyer will be charged for the cost of the test, even if it does not meet his expectations.

In the absence of the decoration test, the acceptance by the Seller follows on the basis of the presented product visualization for the Buyer. The production is carried out strictly according to the accepted visualization of the product. Overprints that have been accepted by the Buyer based on visualization are not subject to change, and all responsibility for the final appearance of the product, made on the basis of an approved visualization, is borne by the Buyer.

Complaints

The ordering party is obliged to thoroughly check the whole of the goods immediately upon receipt.

Since the sale of goods is intended for sale on the market of clothing and gadgets, we do not accept refunds if the goods are in conformity with the order and undamaged.

Complaints are only for goods damaged or incompatible with the order accepted by the Seller. Complaints should be submitted in writing, no later than within 3 days from the date of receipt of the goods by the Ordering Party. Complaints should be made before the decoration on the goods – the goods after processing, decoration or connection with another item is not subject to complaint.

In the case of sending the wrong or damaged goods (with the proviso that the damage occurred before decorating the product), the Ordering Party is entitled to free exchange of goods or supplementing the missing quantity, in case of delivery of quantities inconsistent with the order accepted by the Seller.

We reserve the right to declare the goods delivered by the Seller in accordance with the ordering party’s order, only to the extent and within the limits of the applicable law. The exchange only covers faulty goods in the meaning of the applicable law.

Goods that carry signs of use or have been deprived of original markings or tags, have been changed or damaged, as well as goods with print or otherwise personalized according to the visualization approved by the Employer is not refundable or exchangeable.

Personal data privacy

The administrator of personal data as part of this website is the feelgood limited liability company based in Krakow, ul. Turystyczna 2, 31-213 Kraków, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for Krakow-Śródmieście in Krakow, XI Commercial Division of the National Court Register under KRS number 0000507733, NIP 9452179077, REGON 123104804. The seller takes all technical measures and organizational measures to protect the personal data of Buyers, in particular to prevent unauthorized persons from obtaining and modifying data provided during registration and placing orders.

The website administrator reserves the right to change the conditions of placing an electronic order.

The administrator of the website is obliged within 48 hours of receiving the order to inform the Buyer of any changes in the conditions of the contract. If it is impossible to contact the customer within 48 hours of receiving the order, the order is canceled.

Final provisions

The costs of purchase and transport of designs shall be borne by the Employer, unless otherwise agreed.

Shades of colors in the catalog and on the website may differ from the actual colors of the products. Complaints arising from these differences will not be considered. Please check the actual shade of the product.

Commodity prices are net prices expressed in PLN or in EUR, which will be increased by VAT at the appropriate rate. The prices do not include shipping costs, which are separately included in the VAT invoice.

Goods imported from the producer at the special request of the Ordering Party is not refundable.

The Seller reserves the right to change these Regulations, which is always notified by publishing the current regulations on the bangbag website. Therefore, the Purchaser, each time making purchases, automatically confirms the acceptance of the current Regulations.

The parties will each time attempt to resolve any disputable issues in an amicable way. In the event of a dispute, the competent court will be the court of the Seller’s registered office.

In matters not covered by the above-mentioned Regulations, the provisions of the Civil Code shall apply.

The Seller is not liable for the incorrect operation of the website and losses resulting from its improper work.

The seller is not responsible for temporary shortages of goods from producers.

Regulations come into force on December 20, 2018.
